Background
Cheshire West and Chester Council is undertaking a consultation to support the development of its draft Street Collection Policy.
Anyone wishing to undertake a public collection (of cash) or to sell articles for a charitable purpose in a street (public place) must hold a street collection permit. A permit is not required if the collection is on private property. A permit is also not required if no payment is taken at the time but a commitment to make a donation in the future is given (for example, by setting up a direct debit mandate).
The Council’s draft Charitable Street Collection Policy affects any person, society, committee or other body of persons responsible for any collection of money or sale of any article for charitable purposes in any street or public place. The policy incorporates statutory legal regulations related to street collection legislation and guidance, including the following:
the conditions/regulations under which permits are granted
guidance on how applicants should conduct a street collection
an explanation of the local restrictions that further control or prohibit collections in some locations within the borough
an explanation of when exemptions for street collection permits/requirements will be considered
an explanation of when a permit will not be granted.
Whilst the statutory legal regulations within the policy cannot be amended, there are some elements of the policy which are discretionary that we welcome your views on. These include:
